These terms are an agreement between you and SIA NOTNA SOFTWARE, registration number 40203531194, Cialkovska iela 10–60, Daugavpils, LV-5410, Latvia ("we", "us"). They cover your use of the Gridhaiku app (the "App"). By downloading or using the App, you agree to them. If you don't agree, please don't use the App.

1. Your licence

We give you a personal, non-exclusive, non-transferable and revocable licence to download and use the App on devices you own or control, for your own non-commercial entertainment. All rights we don't expressly grant are reserved.

2. Your account

The App creates an anonymous account so it can keep your progress. You can optionally sign in with Apple or Google to keep your progress across devices. You're responsible for your device and the accounts you sign in with. You can delete your account and data at any time in the App's settings. Our Privacy Policy explains how we handle your data.

3. The puzzles and the service

• New daily puzzles need an internet connection to download. Your network provider's charges may apply.
• Streaks, statistics and puzzle availability are provided for fun. We work hard to keep them accurate, but we don't guarantee that the service will be uninterrupted or error-free, or that your progress can never be lost.
• Percentiles are estimates based on the solves counted on our servers. They appear once enough players have solved a daily, update about hourly while it's open, and may change or be unavailable.
• Times in links your friends share come from their device and aren't verified by us. Challenges are for fun and don't affect your streaks, statistics or percentiles.
• We may change, add or remove puzzles, features and content, and we may stop offering the App. If we stop, we will give reasonable notice where we can, and we will treat purchases fairly as described in section 4.
• Some features may require a recent version of the App or of your device's operating system.

4. Purchases and subscriptions

The App is free to download and play. It offers optional purchases:

• Premium: a subscription, for a week, a month or a year as offered, that removes ads and unlocks extra content, such as older days in the Archive, harder levels and larger sizes in Unlimited, and longer statistics. The App shows what Premium includes before you buy.
• Remove Ads: a one-time purchase after which you see no ads unless you choose one for extra hints. It doesn't include what Premium unlocks.

For every purchase:

• Payment: purchases are made through the Apple App Store or Google Play and are subject to their terms. The price, and for subscriptions the billing period, is shown before you confirm.
• Renewal: subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before it ends. You can manage or cancel a subscription in your App Store or Google Play account settings. Deleting the App or your account doesn't cancel a subscription.
• Price changes: we may change subscription prices. Apple or Google tell you before a new price applies to your subscription and, where their rules require, ask you to agree. If you don't, the subscription ends at the end of the period you've paid for.
• Free trials: if we offer one, it turns into a paid subscription when it ends unless you cancel before then.
• Refunds: refunds are handled by Apple or Google under their refund policies.
• Right of withdrawal: if you're a consumer in the EU or UK, you normally have 14 days to withdraw from a purchase of digital content. When you buy, you ask us to give you access straight away and acknowledge that you lose this right once access begins. This doesn't affect your other statutory rights.
• Restoring purchases: purchases are tied to your App Store or Google Play account. You can restore them on another device signed in to the same store account. If you've signed in to the App with Apple or Google, purchases also follow that account to your other devices, including on the other platform.
• What's free and what's paid: we may change which features are free, which ask for an ad and which need a purchase. We won't take away something you've paid for during a period you've paid for, and with Remove Ads you see no ads unless you choose one, for as long as we offer the App.
• If we stop: if we stop offering the App or a paid feature, we'll stop new subscription charges for it and refund the unused part of a paid period where the law requires.

5. Ads

The free version of the App may show ads provided by Google AdMob. We're not responsible for the content of third-party ads or for the websites or apps they link to. How ads use your data is explained in our Privacy Policy.

Some features offer an optional video. Watching it to the end gives a reward, such as extra hints or checks, or unlocks a puzzle or feature. Rewards have no cash value, can't be transferred, and some don't last: for example, the longer statistics a video opens close again at midnight. If no video is available, there's no reward, but you can try again later.

6. Acceptable use

Please don't:

• copy, modify, distribute, sell or rent the App or its puzzles, except as the law expressly allows;
• decompile or reverse engineer the App, except to the extent the law permits despite this restriction;
• use bots, scripts or other automated means, or exploit bugs, to manipulate streaks, statistics, percentiles or other features;
• edit shared links or claim times you didn't achieve, to mislead other players or skew percentiles;
• interfere with or try to gain unauthorised access to our servers, or put an unreasonable load on them;
• use the App for anything unlawful.

If you break these terms, we may suspend or end your access to the App's online features.

7. Intellectual property

The App, including its puzzles, design, text, graphics, code and the Gridhaiku name and logo, belongs to us or our licensors and is protected by intellectual property laws. Open-source components are used under their own licences, which you can read in the App under Settings › About.

8. Third-party services

The App relies on services from third parties, including Google (Firebase and AdMob), RevenueCat, Apple and Google Play. Their own terms and policies apply to your use of those services.

9. Our liability

The App is provided "as is" and "as available". To the extent the law allows, we don't give warranties beyond those you have by law.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, for intentional or grossly negligent harm, or for anything else that can't be limited by law. Nothing in them affects your statutory rights as a consumer. Otherwise, we are not liable for indirect or unforeseeable loss. Our total liability to you is limited to the amount you paid us for the App in the 12 months before the claim, or EUR 50 if that is more.

10. Changes to these terms

We may update these terms, for example when we add features or when the law changes. We will publish the new version on this page with a new effective date, and tell you in the App about significant changes. If you keep using the App after a change takes effect, you accept the new terms. If you don't agree, you can stop using the App and delete your data.

11. Governing law and disputes

These terms are governed by the laws of the Republic of Latvia. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts of that country or of Latvia. Please contact us first so we can try to solve the problem together.
